Terms of Business & Engagement

The purpose of this page is to set out the expectations we have of our clients, and which they can have of us whenever we engage in business together, whether that is one person completing a Birkman Questionnaire, or a major project across a 10,000 person organisation. These terms apply to every proposal and sale made by Elaura Asia Pte Ltd and Elaura Ltd, unless specifically overridden or excluded in our signed Proposal and Quotation document for that project or piece of work.

A) Why We Do This

  1. Elaura has built its businesses on the primary aim that we do what we do in order to improve the quality of life and experience of work for the people we engage with, and to make the organisations we serve, more effective, liveable and sustainable. Operating our businesses profitably is also important, but can never be at the expense of that primary aim.

  2. Psychological Safety plays a key part in the work that we do; this is not just in terms of how we do our work, but it is also an important outcome of the work we do with Leaders and Teams; we expect our clients to see and value the benefit of their employees feeling safe to bring their full possible contribution to their work and their team.

  3. While it is true that sometimes people are simply in the wrong job or company and that helping them realise that may be in everyone’s interest, including their own; and while it is also true that organisations sometimes need to restructure in order to meet new business realities; we will not knowingly undertake projects which are primarily predicated on a reduction in headcount.

  4. We have a duty of care towards those we work with, individually and in team settings; this means, inter alia, that if we become aware of illegal or abusive behaviour towards individuals or groups of people we will raise this as an issue and, if necessary, report it to the the appropriate authorities.

  5. You can expect us to be honest, trustworthy and professional. We expect the same of you.

 

We reserve the right to terminate projects at any point where serious concerns based on the above 5 items have been raised by us, with the client, and not addressed by them to our satisfaction within 14 days of such notification; work completed but not yet invoiced will be invoiced by us, and all outstanding invoices must be paid current by the client within the agreed payment terms.

B) Financial

  1. You can expect us to invoice in accordance with our proposal and at the timings or milestones set out therein, and to detail the work undertaken which is covered by each invoice; any reclaims of T&E as per the agreed proposal will be itemised with copies of receipts where available.

  2. We expect invoices to be paid on time and without withholdings; in the case of local sales or other taxes, those are at the client’s expense, i.e. on top of the amounts owed to us. We prefer payment by local bank transfer or Wise for international transfers; if you use another method, please ensure that you pay bank charges at both ends of the transaction.

  3. Elaura carries world-wide Professional Indemnity Insurance; contact us for details if you require them.

C) Guarantee

  1. Since 2000, Elaura has always guaranteed that its clients will reach the completion of any project we undertake for them, believing that they have received great value for money; if this is ever not the case, we ask you to contact us within 30 days of the date of completion, after which we will do what we can to make that right. In the event that we are unable to do so in a timely manner, we will agree with you an amount of the project fee to refund to you. Please note that this guarantee does not apply where invoices remain outstanding past their due date, or have not yet been settled, or where the complaint appears frivolous.

D) Credibility of The Birkman Method® (TBM)

  1. Our whole business revolves around the application of the TBM to individual and organisational problems and challenges; we have had plenty of opportunity to add other assessments and methodologies but have chosen not to. It should be clear from this that we believe the TBM to have enormous credibility and to be, by far, the best tool of its kind. The Elaura website you are currently on contains plenty of evidence of this credibility; however, if you would like additional Reliability and Validity data, please contact us.
